HR Ministry encourages employers to support additional Aidilfitri leave

The Human Resources Ministry has urged employers to consider providing additional leave flexibility for their employees following the government’s announcement of an extra public holiday in conjunction with Aidilfitri.

In a statement today, the ministry said such flexibility reflects a responsible and compassionate employment practice that supports workers’ well-being while promoting a healthy balance between work commitments and family life.

The ministry noted that the additional holiday is consistent with provisions under the Holidays Act 1951 (Act 369), which authorises the government to declare public holidays when deemed appropriate.

It added that the declared holiday will also apply to private sector employees in accordance with Section 60D of the Employment Act 1955 (Act 265).

Under the law, employers may replace the declared public holiday with another suitable day as a paid replacement holiday, depending on operational needs.

“Employers are required to inform their employees about the arrangements for the additional leave, whether it will be observed on the declared date or substituted with another day,” the ministry said.

The statement also reminded employers that employees required to work on a declared public holiday must be paid according to the public holiday rate stipulated under the Employment Act 1955.

Prime Minister Datuk Seri Anwar Ibrahim yesterday announced that the government will grant an additional public holiday depending on the date Aidilfitri falls this year.

If Aidilfitri falls on Friday, March 20, an additional public holiday will be declared on Monday, March 23. However, if the celebration takes place on Saturday, March 21, the additional holiday will be observed on Friday, March 20.

The ministry said the measure is intended to provide workers with more time to celebrate Aidilfitri with their families in a meaningful and harmonious atmosphere.

It also encouraged employers to support such arrangements as part of progressive workplace policies that recognise the importance of family and social wellbeing during major festive celebrations.
