Make marital rape a crime
Local NGO, Sisters in Islam (SIS), is pushing for amendments to Section 375 of the Penal Code to specifically make marital rape a crime even if there are no threats or of any danger to lives involved.
SIS stated that although Section 375A offers women protection, it is inadequate as it fails to acknowledge rape directly, but addresses situations where a husband only causes “hurt, fear of hurt, or death.”
However, a contradiction appears because Section 375 states that “sexual intercourse by a man with his wife by a marriage which is valid under any written law for the present in Malaysia is valid and “is not rape.”
SIS explained that Malaysia’s legal framework on marital rape is unclear and does not explicitly classify it as a criminal offence and thus it discourages victims from reporting incidences of marital rape.
Dozens of women in Malaysia have approached SIS to complain of their struggles, trauma and pain suffered while experiencing marital rape and the organisation believes this is merely the tip of the iceberg as there are many more women suffering in silence.
SIS also stated that there are many women who are still confused and even scared to take action against their husbands for marital and other sexual violations as they fear divorce, concern over their children’s future and the perception of people.
