Interim Prime Minister only to maintain status quo
Tan Sri Muhyiddin Yassin had been appointed as Interim Prime Minister by the yang di-Pertuan Agong on Monday (Aug 16) which legal experts assure for status quo.
People’s Legal Team Founder, Dinesh Muthal said even as Muhyiddin is appointed based on the constitution, he cannot draw up policies or execute important decisions.
Dinesh added that the words ‘caretaker’ and ‘interim’ are not legal terms. He referenced Article 43 of the Federal Constitution which states nothing about the role of an interim. In essence, there is no definition of the powers of an Interim Prime Minister.
Fahri Azzat, Director of the Malaysian Centre for Constitutionalism and Human Rights (MCCHR), mentioned that as a caretaker PM, his role is to only manage the government till a new one is established.
“He has to just ‘keep the motor running’ without driving the ‘car’ anywhere,” he added.
Muhyiddin Yassin is currently without a Cabinet as per the constitution it is required for the Cabinet to resign when the Prime Minister does.
The Pagoh MP said on Monday, “Based on my understanding, I am the caretaker Prime Minister. My Cabinet has resigned. There is no longer a government like before. I will hold on to the principles and do what I can, based on the advice of the King and the Attorney-General.”
